Terms of Service
This page defines the terms used across Rocket Refresh pages, invoices, emails, and checkout.
Kickoff
Kickoff Date is the requested start date accepted in writing. Kickoff starts on Kickoff Date after written Kickoff Acceptance and after required payment and required access/assets are received.
Work Start
Work starts at Kickoff. Any build activity, configuration, or implementation after Kickoff counts as work.
Form 1
Form 1 is the initial selection form. Submission is free.
Intake Submission (Form 2)
Form 2 completion is required before Kickoff can be scheduled and approved.
Refund Policy
Cancel before Kickoff Date using the Order Form cancellation method for a full package refund. No refund on or after Kickoff Date except any refund stated in the Order Form.
Pause Periods
A Pause Period is a documented period during which work is paused. Client-caused delays (e.g. late payment, late or incomplete content, late approvals, delayed access, delayed decisions, post-approval changes), third-party vendor or platform delays, and force majeure events create Pause Periods. The timeline and guarantee clock pause during Pause Periods.
Finished
Finished occurs when we deliver the final review link and mark the project status as Finished. We may also send a Finished email notice.
Completed
Completed occurs when (a) you provide written approval with no further revisions, or (b) seven (7) calendar days pass after Finished with no response, the deliverables are deemed accepted, and we may mark the project Completed.
After Completed, we select a Launch date at least seven (7) calendar days after Completed.
Launch Window: Monday through Thursday unless agreed otherwise.
If a Revision Pass is purchased after Completed, Launch is rescheduled until after the new Revision Round is Finished and the project reaches Completed again.
Preview
A preview is a working version shared for review before launch.
Launch
Launch means the site is deployed to the live domain or agreed live URL and is accessible to the public.
Defects
Provider requests written approval prior to Launch via the channel stated in the Order Form (e.g. Client Notice Email to Provider Notice Email). Items approved in writing before Launch are final unless changed through a Change Order.
You have five (5) business days after Launch to submit a Defect notice. The notice must be sent to the Provider Notice Email and must include: affected URL(s), steps to reproduce, expected versus actual behavior, browser and device details, and screenshots or recordings when available. For Defects properly reported within that window, Provider will correct qualifying Defects at no charge for up to fourteen (14) calendar days after Launch (excluding Pause Periods). Defect correction is limited to conformance to the written Scope of Work in effect at Launch; it does not include new requests, new features, or changes requested after approval. Defects exclude subjective preference, previously approved items, client content or systems, third-party services, and issues introduced by client changes after Launch.
Defect fixes are not counted against your revision rounds. Revision rounds are for preference changes and in-scope adjustments within the existing Model structure, not for fixing broken deliverables.
Revision Round
A revision round is for preference changes and in-scope adjustments within the existing Model structure. It is not for fixing defects (see Defects above). In a Model build, revision rounds are primarily for verifying that your content — business name, services, service areas, contact details, and photos — was placed correctly. One round means one consolidated list of requested edits from one decision-maker. Each revision round includes up to 30 revision items or 2 labor hours, whichever occurs first. Identical cosmetic repeats across multiple pages count as one item.
You must review and respond to a delivered revision round within three (3) business days. If you do not respond within seven (7) calendar days after a revision round is delivered, Deemed Acceptance occurs, the work is deemed accepted, and any remaining included revision rounds not yet used are forfeited. Additional revision rounds are available as a Revision Pass for $499 each.
In-Scope Changes
In-scope changes are simple changes that do not alter the Model structure.
- Text edits.
- Replacing images or media.
- Swapping logos.
- Updating contact details and business hours.
- Minor layout adjustments using existing Model components.
- Reordering content within an existing section.
Out-of-Scope Changes
Out-of-scope changes require a separate quote and approval.
- New sections that are not already part of the Model.
- Adding sections, pages, or features not included in your selected package.
- Structural changes to the Model architecture.
- New features such as booking systems, calculators, chat, or custom portals.
- Requests to replicate another website design.
Work begins only after written approval, required payment, and required access/assets are received, as described in the Kickoff definition above.
Included Revision Rounds
This project includes a fixed number of revision rounds for in-scope edits (Starter Refresh: 1, Growth Refresh: 2, Operator System: 3). Each round is one consolidated list of requested edits. Additional rounds are billed as an add-on ($499 each). See the Packages page for details.
Packages
Package names, pricing, timelines, and included items are defined in your Order Form and written scope of work. If there is a conflict, the Agreement controls; the Order Form controls package selections and scope within the Agreement.
One-time add-ons are non-refundable unless your Order Form expressly states otherwise. If an add-on is on the same Order Form as a core package and you cancel before the Kickoff Date, that add-on is refunded with the package.
Client Responsibilities
You must provide the assets and information requested in the Order Form / Form 2 before Kickoff can be scheduled. Standard required assets include:
- Business name and logo (vector or high-resolution PNG preferred)
- Photos of your work, team, or vehicles
- Full list of services you offer
- Service area (cities and/or zip codes you cover)
- Business phone number, email address, and physical address
- Business hours
- Any existing reviews or testimonials you want included
You must review and respond to revision rounds within 3 business days to avoid Pause Periods. Missing inputs, delayed approvals, or delayed access create Pause Periods.
Handoff
Handoff means you receive admin access and control of your deployed site as described here. It is not a transfer of Rocket Refresh Model IP (see Intellectual Property below).
Included in handoff: Admin access to your site; Owner's manual; deployment/repository access and control of your project instance as provided by the delivery method; ability to manage hosting and content yourself.
Not included: Ownership of Rocket Refresh Models or reusable components we use to build sites. We retain those for our business; you receive a license to use your built site. Stock imagery is available as a quoted add-on and is subject to its own license terms.
Intellectual Property and Client Content
Your content and brand: You keep ownership of content, photos, and brand assets you provide. You represent that you have the rights and permissions needed for us to use them in your project. If we receive an IP complaint about content you provided, we may ask you to replace or remove it; you are responsible for resolving such claims.
Rocket Refresh IP: Our Models, code patterns, and reusable components remain our intellectual property. We grant you a license to use the built site we deliver for your business. We may use the same or similar Models and components for other clients.
Ownership
You can take over the site any time. Without a retainer, you receive full handoff after launch (as defined in Handoff above). With an active retainer, we provide and manage hosting and retain operational control, but you can request handoff at any time.
Hosting
With an active retainer plan, hosting is provided and managed by us via Vercel. Without a retainer plan, you are responsible for ongoing hosting after handoff.
Governing Law
These Terms and any disputes arising from or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
Performance Snapshot and Communication
Performance results such as rankings, revenue, traffic, and conversions vary based on market conditions, competition, and your ongoing business operations. At launch we provide a Launch Snapshot that captures the starting state of your project.
We aim to respond promptly to project communications to keep your work moving on track.
Limitation of Liability and Warranty
To the fullest extent permitted by law, our liability for any claim arising from or related to the Services is limited to the amount you paid for the project or service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. We provide the Services "as is" and disclaim all warranties, express or implied, except as expressly stated in these Terms. This section does not limit your rights under applicable consumer law where they cannot be waived.
Changes to These Definitions
Definitions may be updated over time. The version included with your purchase is the version that applies to your project, unless you agree to an updated version in writing.
